Immediate Post-Death
Interest Will Trust
Nobody wants to think of their partner not being taken care of if they pass away – and an Immediate Post-Death Interest Will Trust (IPDI) is a way to give them immediate support while making sure the capital in your estate is protected for other beneficiaries (usually your children).
The trust is usually established in your will, and gives your spouse or civil partner the right to income from or use of trust assets immediately but not outright ownership, thus protecting the assets themselves for your children. These are passed on after your partner’s death.
As well as giving immediate support for either partner and protecting your legacy for future beneficiaries, it means assets transfer automatically without delays, family conflicts are avoided and Inheritance Tax exposure can be managed across both estates.
The benefits of an Immediate Post-Death Interest Will Trust include:
Immediate support for either partner
- The surviving spouse or partner has access to income immediately
- The right to live in the property for life
- The option to move to a more suitable property
Protects your legacy for your children
- Capital is preserved for the next generation, especially in the case of children from a previous relationship
- It’s protected against remarriage from a surviving spouse or new partners
- It’s protected against changes to a Will
Smooth succession
- Assets transfer automatically without delays
Reduces family conflict and sideways disinheritance
- With a clear legal structure and instructions, disputes over your estate are prevented
- Your children’s inheritance remains protected
Care fees
- As the surviving spouse does not own your share outright, the local authority cannot treat it as their asset in a care assessment
Inheritance Tax planning
- An IPDI can help manage tax exposure across both estates
- An IPDI is recognised by HMRC and treated as part of the spouse/ partner’s exemption for IHT
Immediate Post-Death Interest Will Trusts have become very popular, especially with couples who have been married before or have children from a previous relationship. We can advise you on whether it’s right for you, and make setting up a tailored IPDI simple.
